Oxygen Concentrator Rentals

1. Rental Agreement

This rental agreement is between OxygenC / ICM Industries SA ("the Company") and the renter ("the Customer"). By renting a medical device from us, the Customer agrees to be bound by these Terms & Conditions.[reference:4]

2. Rental Period and Fees

Rental fees are quoted based on the agreed duration (daily, weekly, or monthly). Full payment for the rental period is required in advance before delivery. Rental fees are charged for each rental cycle or part thereof.[reference:5][reference:6]

A delivery and return charge may apply and will be advised at the time of booking.[reference:7]

3. Ownership and Security

All equipment remains the property of OxygenC at all times. The Customer shall not sell, transfer, or modify the equipment in any way.[reference:8][reference:9]

A security deposit may be required for certain rentals. This deposit is fully refundable upon return of the equipment in original condition, normal wear and tear excepted.[reference:10]

4. Customer Responsibilities

The Customer is responsible for the equipment at all times during the rental period.[reference:11]

• Use the equipment only for its intended medical purpose and in accordance with the manufacturer's guidelines[reference:12]
• Keep the equipment safe, secure, and in good condition
• Not repair or attempt to repair the equipment without written consent[reference:13]
• Notify the Company immediately of any breakdown or defect[reference:14]

5. Damage, Loss, and Late Returns

The Customer is liable for any loss, theft, or damage to the equipment (beyond normal wear and tear) during the rental period.[reference:15][reference:16]

Replacement cost (up to full retail value) may be charged for lost or severely damaged units. Late return fees apply at R250 per day for daily rentals or 25% of the weekly rental rate per week overdue.

6. Delivery and Return

We deliver the equipment to the address specified by the Customer. At the end of the rental period, the Customer must arrange return of the equipment in the same clean condition and good working order as when received.[reference:17][reference:18]

If we collect, the Customer must ensure the equipment is readily accessible and properly packed in original packaging where available.

7. Equipment Failure

If the equipment breaks down or becomes unsafe to use, the Customer must:

• Immediately stop using the equipment[reference:19]
• Notify us telephonically[reference:20]
• Not repair or attempt repair without our written consent[reference:21]

Upon notification, we will provide a suitable replacement unit as soon as reasonably possible. If replacement is not available, we will refund any unused rental charges.[reference:22]

8. Termination

Either party may terminate the rental agreement with 7 days' written notice. The Customer remains responsible for rental fees until the equipment is safely returned and accepted by us.

We reserve the right to terminate the agreement immediately if the Customer breaches any material term (including non-payment or misuse of equipment).

9. Medical Disclaimer

Oxygen concentrators are medical devices that require a prescription. The Customer confirms they have obtained appropriate medical advice regarding the use of oxygen therapy. OxygenC does not provide medical advice.[reference:23]

10. Governing Law

This agreement is governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 where applicable.[reference:24]
